ANY PERSON OR ENTITY ("User") VISITING, USING, OR OTHERWISE ACCESSING THE SITE AT www.1tribe.xyz (http://www.1tribe.xyz/) (“Site”) OR ANY INFORMATION CONTAINED IN THE SITE AGREES TO AND IS BOUND BY THE FOLLOWING TERMS AND CONDITIONS OF THIS VISITOR AGREEMENT ("Agreement"):

1TRIBE. The Site, together with all content (including User Content), data, and other materials contained in the Site (Content), are owned or controlled by 1Tribe LDA, a company registered in Cape Verde whose registered office is at Palmarejo, Praia, Cape Verde. 1Tribe LDA is referred to in these terms and conditions as "we", "us", "our" or “1Tribe”.

Use of the site: This Site is intended only for the purposes specified on the Site. Use of the Site, and/or the Content is entirely at your own risk. Please note that, while we endeavour to provide accurate and useful information, the Content may be inaccurate and is subject to change, often at very short notice. To the fullest extent permitted by applicable law, all Content is provided without any representations or warranties of any kind and is not intended as specific commercial or legal advice. Specifically, 1Tribe does not represent or warrant that the Site or the Content will be accurate, up-to-date, complete, or free of defects, including (without limitation) viruses or other harmful elements.

Trade Marks: The brands, products, and service names used in this Site (including, without limitation, “1Tribe”) are the trademarks or trade names of 1Tribe LDA or its trading partners unless otherwise stated. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names, or taglines without the prior written permission of 1Tribe.

Registration: If you register with the Site, you must: agree to the terms of the Registered User Agreement; agree to keep your password secure and confidential and not allow anyone else to use your email address or password to access the Site; agree not to do anything that would assist anyone who is not a registered User to gain access to any secured area of the Site; and agree not to create additional registration accounts for the purpose of abusing the functionality of the Site or other Users, or to seek to pass yourself off as another User.

Posting Content and/or Information and/or Data: If you provide any information or post any content or data to the Site, you agree to provide only true, accurate, and complete information, content, and/or data for which you control the relevant rights to us and/or the Site. Any Personal Data provided by Users will be treated with appropriate care and security in accordance with our Privacy Policy.

Limitation of Liability: The user agrees that the liability of 1Tribe to the user under this Agreement shall be limited to the amount the user has actually paid to 1Tribe for its services. Nothing in this Agreement shall operate to limit or exclude liability for death or personal injury caused by the negligence of 1Tribe.

Indemnity: The user agrees to indemnify 1Tribe for any loss or damage that may be incurred by 1Tribe, including without limitation legal fees, arising from the user's use of the Site or the user's use of any information obtained through the Site.

Severability: If any part, term, or provision of this Agreement is held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.

Changes to this Agreement: This Agreement and/or any other terms of service may be changed without prior notice, and any such amendment will be applicable to all Users from the date and time such revised terms have been posted on the Site. The user’s continued use of the Site or services constitutes agreement with and acceptance of any such amendment or other changes.

Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Cape Verde. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Cape Verdean Courts.

1TRIBE REGISTERED USER AGREEMENT

The journey of discovery is one shared by us all. As a diverse and inclusive community, 1Tribe thrives on collaboration and the free exchange of ideas. By becoming a part of our community, you agree to cultivate an atmosphere of respect, understanding, and mutual support.

ANY PERSON OR ENTITY ("User"), REGISTERED TO USE OR ACCESS THE SITE AT www.1tribe.xyz (“Site”) OR ANY INFORMATION CONTAINED IN THE SITE, OR ANY SERVICES PROVIDED TO YOU VIA THE SITE (“Services”) AGREES TO AND IS BOUND BY THE FOLLOWING TERMS AND CONDITIONS OF THIS REGISTERED USER AGREEMENT ("Agreement").

1. Camaraderie: Upon registration at www.1tribe.xyz (the "Site"), you are joining the tribe of 1Tribe LDA, a beacon of unity and creativity registered in Cape Verde with its heart at Palmarejo, Praia, Cape Verde. Please note you must be 18 or older to join our tribe or have the consent of a parent or guardian if you are at least 14 years old.
2. Becoming Part of 1Tribe: In joining us, you agree to provide truthful and precise information. It is important to keep your account details up-to-date to ensure smooth communication and uninterrupted services.
3. Creative Expressions: At 1Tribe, we enable you to express your creativity through various Services, like sharing and downloading music. We may need to adjust or pause any Service at any time. Changes are made thoughtfully and with the intention of improving your experience.
4. Your Contributions: You bring the tribe to life with your User Submissions, which could include pictures, text, messages, music, video, or any other content you share through our Services.
5. Your Creation, Your Ownership: We respect the value of originality and authenticity. You retain ownership of all your User Submissions. Your creativity is yours alone.
6. Granting 1Tribe Access: When you make a User Submission, you allow us to showcase your creativity to the world. You grant us the non-exclusive, royalty-free, perpetual, irrevocable, transferable right to use, display, translate, modify, and distribute your User Submissions.
7. Tribe Etiquette: We believe in a positive and supportive environment. Therefore, any submission that is harmful, offensive, invasive of another's privacy, or otherwise objectionable is against our tribe ethos and will not be accepted.
8. Shared Responsibility: If any User Submission leads to a claim by a third party, you agree to take responsibility and protect us from any loss or damage.
9. Limitations: We strive to provide the best experience possible, but there may be times when errors occur. In such cases, we will not be liable for any indirect or consequential damages.
10. Privacy and Trust: We understand the value of trust. We prioritize protecting your privacy and security, as detailed in our Privacy Policy, which is a part of this Agreement.
11. Change of Hands: If necessary, we have the right to assign this Agreement or our rights and obligations. You may not assign this Agreement without our written consent.
12. Maintaining Balance: If a provision of this Agreement is invalid, all other provisions will continue to be effective. We will strive to maintain the original intention of the Agreement.
13. Persistence: A waiver of any term of this Agreement does not mean there will be a waiver of any other term.
14. Jurisdiction: This Agreement is governed by the laws of Cape Verde. Any disputes will be addressed in the courts of Cape Verde.
